Apple sued over charging issues with Powerbeats Pro headphones

Apple is facing a potential class action lawsuit over charging issues with its Powerbeats Pro headphones.

Apple is facing a new class action lawsuit today over battery issues with its Powerbeats headphones. Alejandro Vivar, who lives in New York, has filed a potential class action lawsuit, alleging that a design flaw in the Powerbeats Pro headphones prevents them from charging properly. Because it would be too easy to lose contact between the earbuds and the charging case, one of the earbuds either never charges or runs out of power quickly. According to the plaintiff, the Cupertino-based company would mislead users by announcing the autonomy of the product and would not be able to fix problems that it knew very well about.

Alejandro Vivar’s lawyers suggest that the reason for all this is a combination of a design problem and an insufficiently strong ear tip. According to the case file, buyers even had to insert a “spacer”to keep the charging contacts in contact with the contacts on the case. The lawyers also dismissed the Apple brand’s claims that the Powerbeats Pro are sweat and water resistant, arguing that sweat corrodes the charging contacts.

The plaintiff is asking Apple to “fix”the situation, offer compensation to affected users and pay damages for an undisclosed amount. If this file becomes a true class action, it could cover clients in New York State, as well as Georgia, Michigan, Montana, North Dakota, Oklahoma, Rhode Island, South Dakota, and Virginia.

Contacted about this, Apple (yet) does not want to talk. As is often the case with such cases, it is very unlikely that this case will become a class action or result in any compensation. And don’t expect a big cash flow if you win your case—with rare exceptions, class action lawsuits usually end up in very small amounts. Case to follow!
